This agreement is between you and United Bank of Iowa and any third-party vendors that provides services detailed within. This Service is a mobile banking application available for iPhone and Android devices, as well as other tablet devices and via an internet browser. By agreeing to use the Service, you agree to be bound by the terms and conditions of this agreement, but by others; including, but not limited to the United Bank of Iowa Online Banking Agreement. By agreeing to these terms and conditions, you represent that you have the capacity to be legally bound by it.
Definitions:
“Business Day” is every Monday through Friday, excluding Federal Reserve holidays.
“Mobile Deposit” refers to United Bank of Iowa’s Mobile Check Deposit Service
“Service” refers to United Bank of Iowa’s mobile application
“We, Us, or Our” – As used within this Agreement, refer to United Bank of Iowa, and any agent, independent contractor, service provider, sub-contractor, licensor, designee, or assignee that United Bank of Iowa may involve in the provision of the Service.
“You” and “your” shall refer to each customer who is eligible for and uses the mobile application.
1. Service Features
United Bank of Iowa’s Mobile Application Service allows for the user to utilize the features of the Online Banking platform on a mobile telephone or other mobile device detailed above. It is only available to Online Banking customers of United Bank of Iowa. Additional features available in the Mobile Application Service are detailed below.

- General
Access to United Bank of Iowa’s Online banking services via your mobile device is powered by Jack Henry and Associates (the "Licensor"). The Licensor is not the provider of any of the financial services available to you through the Software (defined within), and Licensor is not responsible for any of the materials, information, products or services made available to you through the Software. - Ownership
You acknowledge and agree that the Licensor is the owner of all right, title and interest in and to the mobile technology solution made available to you hereunder, including but not limited to any downloaded software and the computer programs contained therein, as well as any accompanying user documentation, and all subsequent copies, updates or versions thereof, regardless of the media or form in which they may exist (all of which is collectively referred to herein as the "Software"). You may not use the Software unless you have first accepted the Mobile Terms and Conditions. - Updates. The terms of this Agreement may periodically be updated. Upon the update of this agreement, the user will be notified of the update from within the Service.
- Text Messages. Text messaging services are provided by United Bank of Iowa. You and United Bank of Iowa are solely responsible for the content transmitted through text messages sent between you and United Bank of Iowa. You must provide source indication in any text messages you send (e.g. mobile telephone number, "From" field in text message, etc.) You are responsible for any text message fees charged by your wireless carrier.
2. Mobile Check Deposit Service
Mobile Deposit is designed to allow you to present an image of a legal representation, as defined by federal law, of a check to be deposited United Bank of Iowa checking or savings account electronically.
As part of Mobile Deposit, you must only use official and up to date United Bank of Iowa applications. You are responsible for all the data that you submit which must accurately represent the information on the original check(s). You agree that the electronic image of the item submitted to United Bank of Iowa, as defined by federal law, is a legal representation of the check for all purposes, including return check processing.
When using Mobile Deposit, you may experience technical or other difficulties. United Bank of Iowa does not assume liability for any technical or other difficulties that you may incur. United Bank of Iowa reserves the right to change, suspend or revoke services, immediately and at any time without prior notice to you. In the event Mobile Deposit is not available to you, you acknowledge that you can attempt to deposit your check at a branch office location, through a participating ATM, or by mail.
- Eligible Accounts
Only Checking and Savings accounts are eligible for Mobile Deposit. - Charges or Fees
United Bank of Iowa does not charge a usage fee for Mobile Deposit. United Bank of Iowa reserves the right to start charging for Mobile Deposit at any time. If an item you transmit for deposit is dishonored, rejected or otherwise returned unpaid, you agree that United Bank of Iowa may charge back the amount of the return to the account the check was originally deposited to, and you will be assessed a fee in the amount shown on United Bank of Iowa current Schedule of Limits and Fees for a returned check. If there are not sufficient funds in my account to cover the amount of the returned check, the account will be overdrawn and you will be responsible for payment. You agree United Bank of Iowa may debit any account maintained by you in order to obtain payment of your obligations under this Agreement. You acknowledge that wireless providers may assess fees, limitations, or restrictions. You agree that you are solely responsible for all such fees, limitations, and restrictions, and that United Bank of Iowa may contact you via your wireless device for any purpose concerning my accounts at United Bank of Iowa, including but not limited to account servicing and collection purposes. - Eligible Items
You agree to scan and deposit only "checks" as that term is defined in Federal Reserve Regulation CC, Availability of Funds and Collection of Checks. - Ineligible Items
You agree that you will not use Mobile Deposit to scan and deposit any ineligible items including but not limited to the following: multiple party checks, third party checks, poor quality checks, incomplete checks, non-negotiable checks, foreign checks, suspected fraudulent checks, or altered checks. - Endorsement Requirements
You agree to endorse all items with your signature, and print "For Mobile Deposit Only" on all items. United Bank of Iowa reserves the right to reject all items that are not endorsed as specified. - Deposit Limits
When using Mobile Deposit to deposit funds, such deposits are limited to the United Bank of Iowa’s defined deposit segments and associated limits. - Receipt of Items
United Bank of Iowa reserves the right to reject any item transmitted through Mobile Deposit, at United Bank of Iowa’s discretion. United Bank of Iowa is not liable for items United Bank of Iowa does not receive or for images that are not transmitted completely. An image is considered received when you receive a confirmation screen after submitting your Mobile Check Deposit. However, such notification does not mean that the transmission was without error. Once an item is reviewed and approved, your account will be credited in accordance with United Bank of Iowa’s Funds Availability Policy. - Retention and Disposal of Items
You agree to retain each Mobile Check Deposit item for ninety business days after your funds have been posted to your account. After ninety business days, you agree to dispose of the item(s) in a way that prevents representing for payment (i.e. shredding). Upon receipt of these funds you agree to mark the item prominently as "Void", and you agree to store each retained item in a secured locked container until such proper disposal is performed. you will promptly provide any retained item to the United Bank of Iowa as requested to aid in the clearing and collection process or to resolve claims by third parties with respect to any item.
3. Information
You are responsible for the accuracy and completeness of all information and data provided or input by you (including all account information, email addresses, cell phone number, funds transfer amounts, and any recipients of funds), as well as for maintaining the confidentiality of any user name and password that allows you access to the Service. By providing us with your email address or cell phone number, you agree to receive all alerts or other notices by email to that email address or by text to that cell phone number. It is your responsibility to update or change your email address and cell phone number as necessary. We reserve the right to discontinue sending alerts of other information or notice to, or to not effectuate any funds transfers or other transactions associated with, any email address or cell phone number and related debt card if any email to the address or any text to the cell phone number is rejected or we have any other issues or concerns regarding any email address or cell phone number, and without notice to you.
Notices by email may be provided in the format selected by us or through a link to the appropriate page on our website, accessible through any standard, commercially available internet browser. Notices by text will be provided in the format selected by us to the cell phone number provided by you.
You also acknowledge and agree that we may share your name, email address, cell phone number, and other information with any person that you engage in a transaction with pursuant to the Service, including in connection with your receipt or payment of funds through the Service.
Alerts may also contain some information about you or your accounts. Depending upon which alerts you select, information such as account balance may be included. Account information, including your name, email address, and cell phone number, will also be provided to the other party to any funds transfer transactions. Anyone with access to your cell phone or email will be able to view the content of these alerts and your transaction information. It is your responsibility to maintain the security of your cell phone and email.
4. Account Information
You represent that you are the legal owner of the accounts and financial and other information which you access via the Service. By submitting information, data, passwords, usernames, PINs, other log-in information, materials, and other consent to us and our service providers through the Service, you are representing that you have the right to submit such information and you are perpetually licensing that content to us and our service providers and permitting us and our service providers to use and store the content for the purpose of providing you the Service and as otherwise permitted of required by law, rule, or regulation. You expressly authorize us and our service providers to access your account and other information.
You represent that you are the legal owner of the accounts and financial and other information which you access via the Service. 5. Your Use of the Service
Your right to use the Service is personal to you and is not transferable or assignable by you to any other person or entity. In order for us to provide the Service to you, you must keep you email address, cell phone number, and other profile and registration information current and accurate. Your access to the Service may be interrupted from time to time for various reason, including but not limited to equipment malfunction, periodic updating, maintenance, or repair, or other actions that we or our service providers may elect to take in our sole discretion. You shall not use the Service, or allow the use of the Service, for any illegal purpose or in a way that violates any foreign, federal, state, or local law, rule, regulation, ordinance, or order.

Subject to your compliance with this Agreement, you are hereby granted a personal, limited, non-transferable, non-exclusive, non-sublicensable, and non-assignable license to download, install, and use the software associated with the Service on your wireless device within the United States. In the event that you obtain a new or different wireless device, you will be required to download and install the software associated with the Service to that new or different wireless device and to delete the software associated with the Service from your wireless device that has been replaced. This license shall be deemed immediately revoked and terminated upon any termination of the Service or this Agreement, your noncompliance with this Agreement, your deletion of the software from your wireless device, or upon our written notice to you at any time, with or without cause. In the event the license is revoked or terminated for any reason, you shall promptly delete the software associated with the Service from your wireless device. We and our service providers reserve all rights not expressly granted to you in this Agreement.

7. Charges for the Service
Any associated charges for the Service will be accordance with our current fee schedule that can be amended from time to time. Any amendments will be given to you with sufficient advance notice. Additionally, you acknowledge that message and data rates assessed by your mobile carrier. may apply to text messages sent to you pursuant to the Service.

8. Termination of Enrollment
You may cancel your enrollment with the Service by contacting United Bank of Iowa at 712-364-3393 or writing to us at 501 Second Street, Ida Grove, IA 51445.The deletion of the application from your wireless device will not in itself cancel your enrollment in the Service. We reserve the right to cancel or change any or all of the Service at any time without notice. We may also cancel or suspend your access to the Service at any time without notice and for any reason, including but not limited to your non-use of the Service for such a period of time determined by us. Your enrollment in the Service shall also automatically terminate, without notice, in the event our right to offer and provide the Service is lost or terminated, for whatever reason.
